Criminal Defense

Wilka and Welter, LLP understand that we do not live in a perfect crime-free society. Unfortunately, however, the legal system sweeps up some innocent people in its search to find justice. We are committed to protecting those individuals' rights under the law until they proven guilty and after.

Crimes are divided into two classes: misdemeanors and felonies. Misdemeanor offenses are not as serious as felony offenses and typically do not involve great bodily harm to another person and are punishable by probation, jail time of less than one year, community service, counseling, restitution, and monetary fines.

Misdemeanor crimes include:

  • Possession of cannabis under 20 grams
  • Petty theft
  • Drunk driving
  • Beverage law violations
  • Disorderly conduct
  • Disorderly intoxication
  • Battery
  • Criminal traffic violations
  • Trespass

Felonies comprise the most serious criminal offenses including bodily harm to another person or large sums of money. A felony conviction can result in a prison term of more than a year, lengthy probation, large fines, or even the death penalty.

Felonies include:

  • Possession of cocaine (or other narcotics)
  • Delivery or possession with intent to deliver cocaine (or other narcotics)
  • Driving while license suspended as a habitual offender
  • Grand theft
  • Burglary
  • Embezzlement
  • Domestic violence
  • Aggravated assault

If you have never faced criminal charges before, you may not be aware of the legalities of the criminal process and the repercussions you may face. Wilka and Welter can help you understand the charges filed against you, your available defenses, the plea bargains that may be offered, and the penalties and fines you may expect if you are convicted. The most important thing to keep in mind if you are facing a criminal charge is that you have the right to remain silent and should exercise that right. You should also retain legal counsel as soon as possible to protect your rights.
